Belgian Court annuls abolishment of VAT exemption for online games of chance and bets

After VAT was imposed on online games of chance and bets in Belgium via Article 31 of the Program Act of 1 July 2016, several gambling operators, as well as the Walloon Region, filed a recourse for annulment with the Belgian Constitutional Court. The Court has now issued its decision, annulling the abolishment of the VAT exemption for online games of chance and bets. Yves Van Damme of Van Aerde & Partners describes the background to this case and analyses the decision.
