Romania’s changing view on profiling health data

Compliance with rules on the processing of health data, including its disclosure to third parties and transfer outside Romania, has been on the agenda of the National Supervisory For Personal Data Processing (‘ANSPDCP’), in recent years. Provisions relating to health data have also been included in Romanian draft legislation (‘Draft Law’) which concerns the implementation of the General Data Protection Regulation (Regulation (EU) 2016/679) (‘GDPR’). At the time of publication, the Draft Law is currently going through an approval process by the Romanian Parliament and is soon to be sent for promulgation by the President. The health data-related provisions in the Draft Law have generated debate among companies involved in this type of processing, especially among life and health insurers and reinsurers, entities involved in clinical trials (such as sponsors and contract research organisations (‘CROs’) and e-health start-ups.
