The French Competition Authority’s Opinion on the online advertising sector

The French Competition Authority (the ‘FCA’) published the results of its two year sector inquiry into data usage in the online advertising sector on 6 March 2018 (‘the Opinion’)1. The FCA’s Opinion stresses the importance of personal data to the thriving online advertising industry but comments that the enforcement of the new data protection regulations should be balanced to ensure that they do not have an adverse effect on competition within the sector. Marie-Cécile Rameau, Partner at Bredin Prat, details the findings of the FCA’s Opinion and the likelihood of deeper investigations to follow.
