The Telecom Regulatory Authority of India’s Net Neutrality Recommendations

At the end of 2017, the Telecom Regulatory Authority of India (‘TRAI’) issued a set of non-binding recommendations on net neutrality to India’s Department of Telecommunications, which had sought the TRAI’s views on the matter. Jaideep Reddy and Gowree Gokhale of Nishith Desai Associates consider firstly the provisions relating to net neutrality that currently exist within Indian law, before discussing the TRAI’s Recommendations and the exceptions to the principle of net neutrality outlined in the Recommendations.
