Brazil: The territorial reach of the Internet Law

The applicable law to web-based activities has been a matter of much debate worldwide. While companies generally organise their businesses in accordance with the laws of where their headquarters or servers are located, online businesses can be accessed from virtually anywhere in the world, leading to potential conflicts of law. Gabriela Paiva Morette, Associate at Trench Rossi Watanabe, discusses how the Brazilian Internet Legal Framework (Federal Law No. 12.965 of 23 April 2014) (‘the Internet Law’) sought to address this issue and what this has meant for companies in practice.
