China: The next stage in the progression of security standards

The latest development in terms of data privacy in the People’s Republic of China (‘PRC’) comes in the form of a standard, GB/T 35273-2017 (‘the Standard’). In particular, the Standard, issued on 29 December 2017, and implemented on 1 January 2018, is the fruit of the National Standardization Administration of China (‘SAC’) under the jurisdiction of the National Information Security Standardization Technical Committee (‘TC260’). Although non-binding in application, understanding the essence of the Standard will allow operators to anticipate upcoming regulations, integrate technicalities with the same understanding as the SAC, and include new principles into their operational strategies. In this article, Gregory Louvel, Partner at Leaf Legal, analyses the Standard’s provisions, both in terms of its implications for operators and as a strong indicator of the direction the regulator could tend towards in the near future, once it enters into force on 1 May 2018.
