Netherlands: AP approves DFW copyright enforcement

The Dutch data protection authority (‘AP’) announced, on 7 December 2017, its decision on the collection of IP addresses of internet users that download unauthorised movies by Dutch Film Works (‘DFW’), which serves as an example of how organisations can document their processing operations to demonstrate that the proportionality and subsidiarity principles are followed, and to even get a stamp of approval from the regulator. Wouter Seinen and Sari van Grondelle, Partner and Associate at Baker McKenzie Amsterdam respectively, provide their views on the merits of the decision and its relevance under current data protection laws and the General Data Protection Regulation (Regulation (EU) 2016/679) (‘GDPR’).
