A new regulation to strengthen cyber security protection requirements in China

The People’s Republic of China (‘PRC’)’s Ministry of Public Security (‘MPS’) released its draft Regulation on Multi-level Protection of Cyber Security (‘MLPS Regulation’) for public consultation on 27 June 2018. The MLPS Regulation is supposed to become an implementing rule of the PRC’s Cyber Security Law, which came into effect in June 2017. It also aims to replace the Administrative Measure for Multi-level Protection of Information Systems (‘MLPS Measure’), which was issued by the MPS jointly with other authorities in 2007, which was not well enforced. Xun Yang and Jianqi Yang of Llinks Law Offices discuss the key developments of the MLPS Regulation and the MLPS Measure, and its potential implications for network operators in China.
